For a defense manufacturer, the road to a foreign market doesn't start with a signed contract. It starts with a question that has to be answered first: what is this product, legally? The technical characteristics, the functional purpose and how the equipment gets used all decide whether it falls under state export control, and which permits it needs before it can leave the country.
A Ukrainian manufacturer of high-precision guidance systems for drones (UAVs) came to us with exactly that question, before it had answered it themselves.

Who's involved
This case study covers a Ukrainian manufacturer of high-precision guidance systems for drones (UAVs) that was weighing whether to export its product. The company needed to know which category its product belonged to, which countries it could legally supply, and how to get through the relevant permit procedures.
The challenge
The manufacturer's guidance systems could carry different legal statuses depending on their characteristics and how closely they were integrated with other components. The product could be treated as a good of military purpose, as a dual-use good, or as equipment not subject to special control at all, and which one applied was not obvious from the outset.
On top of that, the classification had to account for sanctions restrictions, the destination country, the end user and the intended purpose of use. Getting any one of those wrong carried real consequences, not a procedural delay.
What was at stake
At the same time, the client needed to get through the whole process without uncontrolled disclosure of its technical characteristics and other sensitive information about the product, a constraint that shaped how the classification and permit work itself had to be carried out.
What we did
We built the manufacturer's path to export across five pieces of work, with our legal partner handling the regulated legal steps.
- 1Technical-legal classification. We ran a combined technical and legal analysis of the guidance systems, their characteristics, functional purpose and possible use scenarios, and compared them against the categories in Ukraine's national and European control lists. The analysis showed that the product's legal regime depends on its level of integration with the drone and its other components. So instead of one universal answer, we built separate classification scenarios and set out the requirements for each.
- 2A step-by-step export algorithm. Based on that analysis, we developed an export algorithm covering:
- determining the product's final classification;
- interaction with Ukraine's State Export Control Service;
- preparing the technical and contract documentation;
- obtaining the necessary opinions and permit documents;
- verifying the supply conditions and the product's end use.
- 3Sanctions and counterparty compliance. As a separate workstream, we analyzed the potential restrictions on the countries the product could be supplied to, on the counterparties involved, and on the ultimate beneficiaries and users of the product.
- 4Contract structuring recommendations. We advised on structuring the manufacturer's foreign-trade contracts, proposing terms to confirm the end user and the intended use, restrict re-export, and set out liability for breaching the agreed supply conditions.
- 5Controlled disclosure of technical information. To protect the technology, we defined the order in which technical information would be submitted to state authorities and counterparties, a process built to pass the required checks while limiting disclosure of the product's sensitive characteristics.
The outcome
The manufacturer received a comprehensive legal opinion on the possible classification options for its guidance systems and the export requirements attached to each one.
The export algorithm gave the company a clear understanding of which documents it needed, which checks it had to run, and which conditions to build into its contracts before starting any supply.
The sanctions analysis and counterparty-verification procedure helped the manufacturer minimize the risk of dealing with an improper recipient, and the risk of breaching restrictions on end use or re-export.
As a result, the manufacturer had a legal foundation for negotiating with foreign partners and planning its entry into international markets. The approach we built can also be applied when the company exports its other technological components, including optics, electronics and software.
What this case shows
Export control for a DefenceTech business is not a formality to clear right before a shipment goes out. It needs to be part of the picture from the moment a contract is drafted and commercial terms are negotiated.
Correct product classification, counterparty verification and documented end use all directly decide whether a company can legally reach an international market, or not.
What this means for you
